TikTok Inc. has filed a lawsuit challenging Montana's recent ban on the use of the Chinese-owned short-video app. The ban, set to take effect on January 1, is being

contested by TikTok on the grounds that it violates the company's and users' First Amendment rights.

The lawsuit was filed in the U.S. District Court in Montana and also argues that the ban infringes upon matters under exclusive federal jurisdiction, thus conflicting with federal law. Additionally, TikTok asserts that the ban violates the Commerce Clause of the U.S. Constitution, which restricts the authority of states to enact legislation that unreasonably burdens interstate and foreign commerce.
